China increases penalties for workplace safety violations in new law amendment

BEIJING -- China's top legislature on Thursday adopted an amendment to the Law on Workplace Safety.

The amendment stipulates heavier penalties for workplace safety violations by production and business operation entities and their responsible persons.

It also adds provisions concerning the new situation of workplace safety in emerging industries, including the platform economy, as well as other prominent problems affecting workplace safety efforts.

Lawmakers approved the amendment at the closing meeting of a regular legislative session of the Standing Committee of the National People's Congress, which started in Beijing on Monday.

The latest amendment will come into force on Sept 1, 2021.

新華社北京6月10日電（記者劉夏村）10日閉幕的十三屆全國人大常委會第二十九次會議對安全生產(chǎn)法進(jìn)行了修改。新修改的安全生產(chǎn)法進(jìn)一步加大對生產(chǎn)經(jīng)營單位及其負(fù)責(zé)人安全生產(chǎn)違法行為的處罰力度。

　　具體而言，新修改的安全生產(chǎn)法在現(xiàn)行規(guī)定的基礎(chǔ)上，提高了對違法行為的罰款數(shù)額；增加生產(chǎn)經(jīng)營單位被責(zé)令改正且受到罰款處罰，拒不改正的，監(jiān)管部門可以按日連續(xù)處罰等規(guī)定。

　　針對安全生產(chǎn)領(lǐng)域“屢禁不止、屢罰不改”等問題，新修改的安全生產(chǎn)法加大對違法行為惡劣的生產(chǎn)經(jīng)營單位關(guān)閉力度，依法吊銷有關(guān)證照，對主要負(fù)責(zé)人實施職業(yè)禁入。新修改的安全生產(chǎn)法還規(guī)定，負(fù)有安全生產(chǎn)監(jiān)督管理職責(zé)的部門應(yīng)當(dāng)加強(qiáng)對生產(chǎn)經(jīng)營單位行政處罰信息的及時歸集、共享、應(yīng)用和公開，對生產(chǎn)經(jīng)營單位作出處罰決定后7個工作日內(nèi)在監(jiān)督管理部門公示系統(tǒng)予以公開曝光，強(qiáng)化對違法失信生產(chǎn)經(jīng)營單位及其有關(guān)從業(yè)人員的社會監(jiān)督，提高全社會安全生產(chǎn)誠信水平。

　　此外，針對平臺經(jīng)濟(jì)等新興行業(yè)、領(lǐng)域出現(xiàn)的安全生產(chǎn)新情況，以及一些當(dāng)前安全生產(chǎn)工作中面臨的突出問題，新修改的安全生產(chǎn)法也增加了相關(guān)規(guī)定。
